All Safe Industries, Inc. provides safety equipment to all types of customers for both business and personal use. Some of the products we have available are geared toward first responders, military personnel, law enforcement, healthcare, and government agencies.  These customers are professionals who are trained and certified on the care and use of different types of technical equipment used in the response to chemical, biological and nuclear events.  Currently, the United States government neither endorses nor approves the use of any CBRN type products by civilian consumers.

Your privacy is very important to us. We have created this privacy statement in order to demonstrate our firm commitment to your privacy. The following information is provided so you know what happens when you visit our site.

What information does your website gather about me?

Registration, Ordering, Opt-In Newsletters
Basically, we only collect the information you choose to share. If you request a catalog, we collect your name and address. If you opt-in to an online newsletter, we ask for your e-mail address. If you place an order, we collect bill to/ship to information and your credit card details. Again, we collect only what you choose to give us. We do not store your credit card account number in any way. We use the information to collect your payment and then the number is securely discarded.

Navigation
Knowing how customers move through our website helps us to improve site design and usefulness. As a result, we use IP addresses to analyze trends, administer the site, track user's movement and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

Sharing
We do not make our customer lists available to outside companies. However, we represent manufacturers whose products will be shipped to your address and in that instance, we provide that information to other sources for your benefit. If you prefer to only share your name with All Safe Industries, please make us aware of that at the time you place your order.

Removing Personal Information
If you wish to be removed from our catalog mailing list or e-mail list, just call 1-888-972-3389 or e-mail us at info@allsafeindustries.com  If you want to opt-out of an online newsletter, follow the simple instructions included at the end of each issue. Because mailing lists are prepared ahead of each promotion, your name may already be scheduled to receive a promotion before the removal from a list takes effect. We will do everything we can to communicate with you in the manner you choose.

Security
We take every precaution to protect the information you give us both online and off-line. When our registration or order forms asks users to enter sensitive information (such as credit card numbers), that information is encrypted and is protected with the best encryption software in the industry--SSL. While you're on a secure page, such as our order form, the lock icon at the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to unlocked, or open, when you're just surfing.

Will I get e-mail if I register or ask for a newsletter?

We send all new members a welcoming e-mail to verify password and username. Registered members will occasionally receive information on products, services, or special offers. If you do not want to receive this information, simply email us at info@allsafeindustries.com and ask to be removed from all e-commerce promotions.  

How does the web site recognize me when I visit?

Cookies are online text files that contain absolutely no personal information about you, nor do they "hold" your credit card account number. The cookie file is sent to your browser from our site when you register. It allows computers to "recognize" each other. When you return to the All Safe Industries, Inc. web site, a number in the text associates your computer with the information we're storing for you at All Safe Industries, Inc.

Return Policy

Our ultimate goal is for you to be satisfied with your purchase from All Safe Industries. We are available through your entire purchasing process to answer questions and supply technical information. Please be sure that your final selection is the product that you wanted. If you decide to return your selection after it arrives, please contact us at 888-972-3389 for return instructions.  All return requests must be made within 30 days of receipt.  Custom and made-to-order items are non-returnable unless there is a defect in quality or workmanship.

Please note: Shipping charges are not refundable. Returned merchandise must be in original factory condition, including all packaging materials, inserts and manuals, warranty cards, and all accessories. We reserve the right to refuse any such returns that have not been authorized or do not include all original items. A 25% Restock Fee will be applied to all returns.

Terms of Sale
The Terms of Sale contain All Safe Industries, Inc.'s conditions of sale. Placement of an order shall be deemed acceptance of the Terms of Sale. Please review these additional terms as they apply to your business location:

Sales Policy: Identification is required from all purchasers. Any and all prices in print or in electronic format are subject to change without notice.

• Quotations: Prices on large quantities or items not found in our catalog are available on request. Contact an All Safe Industries, Inc. Customer Service Representative for assistance (sales@allsafeindustries.com).
• Sales Tax: All Safe Industries, Inc. is required to charge state and local tax on items sold to customers in Kentucky and California. If you are exempt from sales tax, the exemption certificate must be provided at the time of the order.
• Payment Terms: For purchasers with established credit, terms are Net 30 days from date of invoice. If credit is not established, please include pre-payment by check or credit card. We accept American Express, Visa, or MasterCard. All payments must be in US dollars.
• Credit Balance: Customer agrees that any credit balances issued will be applied within one (1) year of its issuance. IF NOT APPLIED OR REQUESTED WITHIN ONE (1) YEAR, ANY BALANCE REMAINING WILL BE SUBJECT TO CANCELLATION AND ALL SAFE INDUSTRIES SHALL HAVE NO FURTHER LIABILITY.
• Freight Policy: FOB ORIGIN. FREIGHT IS PREPAID AND ADDED TO CUSTOMER'S INVOICE ON ALL ORDERS, unless otherwise stated, to customers’ place of business anywhere in the contiguous United States. Any extra charge incurred for additional services, such as haz mat fees or special handling at the destination, must be paid by customer. If any item is backordered on an order qualifying for freight prepayment, that item will be shipped prepaid. Most items are drop shipped directly from the manufacturer. 
• Our website calculates shipping based on UPS standard rates.  If an item is oversized or is shipped via freight there will be additional freight charges incurred.  Please note that not all products can be shipped by express methods.  If you need an item quickly and need it to be shipped overnight, please contact All Safe Industires, Inc. to inquire if expedited service is available for the item and if there are any additional details involved. 
• Claims: If a product was damaged in transit, please note the damage on the delivery receipt and obtain an inspection report from the carrier immediately. Then, contact All Safe Industries, Inc. @ 1-888-972-3389.
• Shipping Hazardous Products: Products considered hazardous require special packaging and additional shipping and handling charges. For specific details, call 1-888-972-3389.
• OSHA Hazardous Substance Product Information: For your convenience, Material Safety Data Sheets (MSDS) are enclosed with all orders that require an MSDS under the Hazard Communication Standard (1910.1200). If you would like a Material Safety Data Sheet before you order, you can request one by calling 1-888-972-3389.
• The information and recommendations contained on the MSDS supplied by the manufacturer are considered to be accurate and reliable. All Safe Industries, Inc., however, makes no warranty with respect to the accuracy or reliability of the information or the suitability of the recommendations.

Local Safety Standards and Regulations

Products sold by All Safe Industries, Inc. are designed to meet stated US Safety standards and regulations. Because local safety standards and regulations vary significantly, All Safe Industries, Inc. cannot guarantee that our products meet all applicable requirements in each locality. The purchaser assumes responsibility for compliance with such safety standards and regulations in those localities in which the products will be shipped, sold and used. Before purchase and use of a product, please review the product application, and national and local codes and regulations, and be sure that the product, installation, and use will comply with them.

Manufacturers' Warranties & Sales Literature

Most of the products supplied to All Safe Industries, Inc. are warranted to the final consumer by their manufacturer. Copies of such warranties are supplied with the product or are available from the manufacturer. As a service, All Safe Industries, Inc. will obtain copies of consumer warranties from the warrantor and will furnish them free of charge to customers who request them. Requests must include the All Safe Industries, Inc. order number and the manufacturer's model number of each product for which a copy of the warranty is requested. All Safe Industries, Inc. may also furnish sales brochures and other literature of the manufacturer. All Safe Industries, Inc. assumes no responsibility for the content of such warranties or sales literature by performing this service.

Trademarks and Copyrights

Purchaser acknowledges that it has no right, title or interest in the trademarks or copyrights in the products, and Purchaser covenants that it will take no action to register or otherwise interfere with such rights.

Governing Law; Limitations

These terms and conditions shall be construed, interpreted and performed exclusively according to the laws, excluding conflict of law rules, of the State of Kentucky, United States of America. Any legal action with respect to any transaction must be commenced within one year after the cause of action has arisen. The provisions of the Uniform Commercial Code as adopted by the State of Kentucky, and not the United Nations Convention on Contracts for the International Sale of Goods, shall apply.

Dispute Resolution

Actions by All Safe Industries, Inc. for nonpayment by the Purchaser of the purchase price of products sold by All Safe Industries, Inc., or for redress of other breaches by the Purchaser of the Terms and Conditions of Sale, may be brought by All Safe Industries, Inc., at its option, before any judicial court of competent jurisdiction. At All Safe Industries, Inc.'s option, disputes between the Purchaser and All Safe Industries, Inc., including all claims for non-performance by All Safe Industries, Inc., shall be finally settled by arbitration in Louisville, KY, Jefferson County under the Rules of the American Arbitration Association, which Rules with respect to matters not regulated by them shall incorporate the UNCITRAL arbitration rules by one or more arbitrators appointed in accordance with said Rules applying these Terms and Conditions and consistent provisions of the internal laws (except conflict of law rules) of the State of Kentucky, USA. All Safe Industries, Inc. will also collect legal fees for this action.

Force Majeure

All Safe Industries, Inc. shall not be liable for any delay in or impairment of performance resulting in whole or in part from Acts of God, severe weather conditions, labor disruptions, governmental decrees or controls, insurrections, war risks, shortages, inability to procure or ship product or obtain permits and licenses, supplies or raw materials, or any other circumstances or causes beyond the control of All Safe Industries, Inc. in the conduct of its business.

Security Interest

On any sales on open account, the Purchaser hereby grants to All Safe Industries, Inc. a priority lien, purchase money security interest and/or chattel mortgage in the products and any accounts receivable or cash from resale thereof until full payment is made to All Safe Industries, Inc.. Purchaser agrees to file any financing statements or other appropriate document with its governmental authorities to assure the validity, priority, and enforceability of the lien. Purchaser agrees to inform All Safe Industries, Inc. immediately if it intends to use any import financing or has or will be granting a lien or security interest on its inventory to any third party.

Assignment

Buyer shall not assign any order or any interest therein without the written consent of All Safe Industries, Inc.. Any actual or attempted assignment without All Safe Industries, Inc.'s prior written consent shall entitle All Safe Industries, Inc. to cancel such order upon notice to Purchaser without liability to All Safe Industries, Inc..

Modification of Terms

All Safe Industries, Inc.'s acceptance of any order is subject to purchaser's assent to all of the terms and conditions of access and sale as set forth herein. Purchaser's assent to these terms and conditions shall be presumed by Purchaser's acceptance of all or any part of the goods or services ordered. All other contrary terms and conditions are expressly rejected, and no addition or modification of terms and conditions shall be binding upon All Safe Industries, Inc. unless agreed to by All Safe Industries, Inc. in writing.

Independent Contractors

All Safe Industries, Inc. and Purchaser are independent contractors. Purchaser is not authorized to and shall not make any representations on behalf of which are binding upon All Safe Industries, Inc.

Separability

If any provision of these Terms and Conditions of Sale shall be deemed illegal or unenforceable, such illegality or unenforceability shall not affect the validity and enforceability of any other legal provisions hereof which together shall then be construed as if such illegal and unenforceable provision or provisions had not been inserted herein, unless such illegality or unenforceability shall destroy the underlying business purpose of these Terms and Conditions.
